US District Court Judge Gloria Navarro has set January 29 as the date of legal battle between Wynn Resorts and Genting Las Vegas about a lawsuit that Wynn filed, accusing Genting of copying its design for the Resorts World Las Vegas.
The Judge told the attorneys of both companies that they have to present arguments explaining how Resorts World Las Vegas does not resemble Wynn and Encore’s design. Wynn argues that Genting’s design is similar to the bronze curved glass design from Wynn’s buildings.
Attorneys for Resorts World argue that with nearly two years left to go before the opening of Resorts World Las Vegas, the facility currently consists of a bare, skeletal structure by a few floors of window panelling. “Upon completion, [Resorts World Las Vegas] will look dramatically different from Wynn’s properties, dispelling any suggestion that a reasonable consumer could confuse the two resorts for each other.”
“The architectural design embodied in defendant’s Resorts World Las Vegas hotel and casino is substantially similar to the plaintiff’s registered copyrighted architectural work and therefore the defendant is violating the plaintiff’s copyrights in addition to the plaintiff’s registered and common law trade dress,” reads the lawsuit.
